Terms of Service
Welcome to JuicyFlutes Inc. (“JuicyFlutes,” “we,” “us,” or “our”). These Terms of Service (“Terms”) apply to your use of our website, juicyflutes.com (the “Website”), and any related services, tools, and products offered through the Website (collectively, the “Services”).
By accessing or using our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Use of the Website
You agree not to misuse the Website or attempt to interfere with its normal operation. This includes, without limitation:
- Using bots, scrapers, or automated tools without written permission
- Attempting unauthorized access to our systems
- Imposing excessive load or disruption on our infrastructure
2. Eligibility
To place an order or upload artwork, you must be at least 18 years old and legally able to enter into a binding agreement.
Our products are currently available for delivery only within Canada and the United States.
3. Products and Custom Orders
JuicyFlutes specializes in custom printed packaging made to order. Because products are manufactured based on your specifications, you are responsible for confirming:
- Box size and dimensions
- Artwork accuracy
- Quantity and product selections
- Print options and finishes
Product images and on-screen previews are representative only. Final printed results may vary slightly due to screen settings, material differences, and production tolerances.
4. Pricing and Payments
All pricing shown in our configurator or product pages does not include applicable taxes or shipping unless stated otherwise.
Payments are processed securely through Braintree, a PCI-compliant third-party payment provider. JuicyFlutes does not store full credit card numbers on our servers.
We reserve the right to correct pricing errors or cancel orders affected by technical mistakes.
5. Order Acceptance
Order confirmation emails do not constitute final acceptance. We reserve the right to:
- Limit quantities
- Request additional verification
- Cancel or refuse service at our discretion
6. Production, Shipping, and Risk of Loss
Shipping timelines vary by product and destination. Once an order ships, ownership and risk of loss pass to the customer upon transfer to the carrier.
Customers are responsible for filing claims related to carrier damage or loss, though we will assist where possible.
7. Cancellations and Refund Policy
Because all orders are custom-produced, orders cannot be changed or canceled once production begins.
Refunds or reprints may be considered only under the following circumstances:
- Verified manufacturing defects
- Orders lost in transit
Any refund or replacement decision is made at JuicyFlutes’ sole discretion after review. Approved refunds will be returned to the original payment method.
8. Uploaded Artwork and User Content
When you upload artwork, logos, or other content (“User Content”), you represent that you own the rights or have permission to use it.
You grant JuicyFlutes a limited license to use your content only as needed to produce and fulfill your order.
We may cancel orders containing unlawful, abusive, infringing, or inappropriate content.
9. Intellectual Property
All Website content, designs, branding, and materials are the property of JuicyFlutes Inc. and may not be copied or used without written permission.
10. Disclaimer of Warranties
The Website and Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
11. Limitation of Liability
To the fullest extent permitted by law, JuicyFlutes Inc. shall not be liable for indirect or consequential damages arising from your use of the Website or purchase of products.
Our total liability for any claim shall not exceed the amount paid for the order giving rise to the claim.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
